Hubei Online Nail Shooting Trial Verdict: Defendant Was ReleasedFrom Criminal Penalty

Today(December 31), a reporter from the Beijing News learned from Gong Shimei thatthe defendant, Gong Shimei, was guilty of illegal possession of afirearm. The facts are clear and the evidence is reliable. In view ofthe minor circumstances of the crime, which did not cause serious consequences,and the defendant had surrendered himself, he was exempted from criminalpunishment.
Defendants guilty of illegal possession of firearms are exempt from criminalpunishment.
According to the Beijing News, Gong Shimei from Shiyan City, Hubei Province wassentenced to one year and one month of control for illegally holding a nail gunin October 2018. The first identification by the public security organshowed that the muzzle specific kinetic energy of the nail gun involved was6.64 Joules / cm2, and the second identification showed 194.14 Joules / cm2.
On April 26 this year, the Shiyan Intermediate People's Court repealed thejudgment of the first instance on the grounds that "the facts of theillegal possession of firearms are unclear and the evidence isinsufficient" and returned to the court for retrial. On May 30, theFangxian Police issued a third appraisal opinion to Gong Shimei, deciding thatthe nail gun involved in the case was a firearm. On the afternoon ofDecember 12, the case began to be re-tried. After the trial, the reporterof the Beijing News learned from the Fangxian court and the defendant Gong Mingwhether the nail gun involved in the case had been reassembled and became thefocus of the court debate. The case was not announced in court.
Today (December 31), the defendant Gong Shimei was filed in a criminal lawsuitby the court, showing that the Fangxian court found that the defendant GongShimei violated the national regulations on gun management and illegally heldfirearms and endangered public safety. His behavior constituted the crime ofillegal possession of firearms. The prosecution charged him with acrime. The facts are clear, the evidence is true and sufficient, and thecrime is found. The court confirmed this.
In response to the defendant's statement of "I don't know who changedit", the Fangxian court held that because the defendant Gong Shimei statedin the interrogation transcript of July 10, 2019 that he had added a gasketunder the barrel in front of the guard circle, the transcript stated Afterbeing confirmed and stamped by the defendant, the nail gun was sent to thematerial evidence appraisal center of the Ministry of Public Security foridentification.
